Terms of Service

These terms cover your use of OpenInfluencer. They are written to be read, not to hide anything. If something here is unclear, write to us and we will explain it.

1. Agreement

These terms are an agreement between you and Argus Technology Corporation ("we", "us") for the OpenInfluencer service at openinfluencer.ai. By creating an account, buying credit or using the service, you accept them. If you are accepting on behalf of a company, you confirm you are allowed to bind it.

If you do not accept these terms, do not use the service.

2. Who can use it

You must be at least 18 and able to enter a contract. The service is intended for commercial and professional use: marketing, content creation and advertising for products and brands.

3. Your account

  • One account per person or business. Keep your password to yourself; you are responsible for activity under your account.
  • Give us an email address you control. It is the only way to recover access.
  • Tell us promptly at security@openinfluencer.ai if you believe your account has been accessed without permission.

4. What the service does

OpenInfluencer generates synthetic people ("characters") from a written description, then generates images and short vertical videos in which those characters present products. Characters are not real people and are not based on photographs you upload.

Generation uses third-party models. Output varies between runs, and we do not warrant that any particular output will meet a particular brief. You approve stills before video is rendered; only what you approve is charged.

5. Your content, and ours

You keep ownership of the prompts, product information and other material you supply. You give us the limited licence we need to process it in order to run the service for you, and for nothing else.

We own the service, the software, the character system and the site. We assign to you whatever rights we hold in the generated images and videos you commission, subject to the law and to the rights of the model providers whose licences flow through to you.

You are responsible for the claims your videos make. If you advertise a product, advertising law in your market applies to you: substantiation, disclosure of paid promotion, and health or earnings claims that you make.

6. Synthetic media and disclosure

Characters are synthetic. Do not present them as real people, and do not use them to imply that a real person said or endorsed something.

Where a platform or law requires synthetic media to be labelled, that obligation is yours. Our exports carry machine-readable provenance marking generated content as synthetic; do not remove it where disclosure is required.

Never use the service to depict a real, identifiable person, a minor, or anyone who has not consented, and never to create sexual content.

7. Acceptable use

You may not use the service to create or distribute material that:

  • depicts a real or identifiable person, or a person under 18, in any way
  • is sexual, sexually suggestive, or sexualises a character
  • harasses, defames, threatens, or invades anyone’s privacy
  • makes false or misleading claims about a product, including health, medical, financial or earnings claims
  • promotes products that are illegal where the audience is, or restricted categories such as tobacco and vaping, cannabis and CBD, prescription medicines, weapons, gambling, or adult products
  • infringes copyright, trade marks, or other rights
  • impersonates a person, brand or organisation, or fakes a public figure
  • interferes with the service, attempts to access other accounts, or circumvents usage limits or billing

8. Credit and payment

  • The service is prepaid. You buy credit with a card through our payment processor, Stripe, and each generation spends credit.
  • The price of a generation is shown before you approve it. Credit has no cash value, is not transferable, and cannot be exchanged between accounts.
  • Payments are handled by Stripe under its terms. We do not receive or store your card details.
  • Unused credit is refundable on request within 30 days of purchase, less the cost of anything already generated. Contact legal@openinfluencer.ai.
  • We may change prices. A change never affects credit you have already bought.

9. Availability and changes

We aim to keep the service available but do not guarantee uninterrupted access. Models, features and limits may change, and a third-party model may become unavailable.

We may suspend or end your access if you breach these terms, if we are required to by law, or if your use puts the service or another customer at risk. Where it is reasonable to do so, we will tell you why.

10. Disclaimers

The service is provided as it is. To the extent the law allows, we exclude implied warranties, including fitness for a particular purpose and non-infringement.

We do not warrant that output will be free of errors, that a character will be identical across every generation, or that a platform will accept your content.

11. Liability

To the extent the law allows, neither party is liable for indirect or consequential loss, lost profits, or lost data. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

12. Termination

You can stop using the service at any time and ask us to close your account. We will delete your account and content within 30 days, except what we must keep by law or for accounting.

13. Changes to these terms

We may update these terms. Material changes will be announced by email or in the product before they take effect. Continuing to use the service after that means you accept the new version.

14. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Disputes will be heard in the state or federal courts located there, and each party consents to their jurisdiction.
